Thinking About Adding a Deck, Patio, or Porch? Here's What You Need to Know
Whether you're upgrading your outdoor living space or planning a new build, understanding the Town's regulations is essential before starting your project. Here’s a helpful summary of the key rules around decks, patios, and porches in Town, based on the current Land Use Bylaw.
When You Don't Need a Development Permit
In the Town of Vermilion, you do not need a Development Permit for a deck, patio, or porch if the structure meets the minimum distance requirements outlined in the accessory use provisions of the Land Use Bylaw.
However, specific placement rules must still be followed depending on where the structure is located on your property:
Location-Based Guidelines
Front Yards

Patios, decks, and porches are allowed, as long as:

They are not enclosed, and
-
They are set back at least 4.5 meters (14.8 feet) from the front property line.

Side Yards

Decks can extend into a side yard, but:

The projection must not exceed 50% of the width of the side yard.

Patios can extend into the side yard, unless:

The side yard requires a 2.59 m (8.5 ft.) width for vehicular access—in that case, projections are not permitted.

Rear Yards

Decks may extend into a rear yard by up to 3.6 meters (11.8 feet).

Patios may extend all the way to the rear property line.
Special Rules for Mobile or Manufactured Modular Homes
If you're adding a deck, patio, or porch to a mobile or manufactured modular home, there are additional rules:

A Development Permit is always required for these additions.

The floor area of the addition must be proportionate to the size of the home.

Decks, patios, or porches are not permitted in the front yard for mobile or modular homes.

Any porch will be treated as part of the main home structure, and must meet minimum separation requirements from adjacent properties.
